Joined at the Hip? A Primer on the Joint-Employer Doctrine

Did you know that a government contractor could be considered a “joint employer” with the Federal Government? Or with one of your subcontractors? Recent developments regarding the interpretation and application of the concept of "joint employer" have drastically increased the responsibility and liability for government contractors, particularly for those prime contractors that coordinate their work forces with the government or with their subcontractors. On August 10, at a program presented by PSC's Human Resources and Labor Policy Committee, PSC will provide a primer on the basics regarding these joint employment issues, what companies need to do before, during and after contract award to be prepared, and how recent legal and government policy actions could affect how contractors operate in the federal market. The renewed attention to this important legal, HR and labor policy, and contracting issue should be of concern to all PSC members – and all of these disciplines should plan on attending this important and unique event.

About the Speakers

  Derrick J. Witherspoon is the Branch Chief for U.S. Department of Labor, Wage and Hour Division (WHD) (Washington, D.C.).  Upon graduation from the University of Central Arkansas (Conway, AR), Mr. Witherspoon has now worked for the agency for over 23 years as an Investigator, Regional Coordinator, and with other roles and responsibilities.  WHD administers and enforces the Fair Labor Standards Act (FLSA), which is the federal law of most general application concerning wages and hours of work and child labor.  All covered nonexempt employees must be paid not less than the current minimum wage of $7.25 per hour for all hours worked up to 40 in a workweek and overtime at one and one-half the regular rate for all hours over 40 in a workweek.     

Natalie Collins works at the Wage and Hour Division National Office as a Senior Advisor for the Branch of Government Contracts Enforcement. Prior to her role as Senior Advisor, Ms. Collins was an Assistant District Director in the Oklahoma City District Office.  While serving as the Assistant District Director, she was also the Home Health Care Coordinator and Family Medical Leave Act coordinator for her office.  Ms. Collins began her career in Wage Hour as an Investigator in the Louisville District Office in 2007. Ms. Collins is also certified as a Federal Executive Board mediator. 

Ms. Collins earned her Juris Doctor from the College of William & Mary, Marshall-Wythe School of Law, where she was an Assistant Editor of the William & Mary Environmental Law and Policy Review.   She also has a M. A. in linguistics from Old Dominion University and a B.A. in linguistics from the University of Kentucky.

  Declan Leonard leads the Employment Law practice at Berenzweig Leonard, where he and his team work with companies and executives in the Washington Metropolitan area and throughout the United States to navigate the maze of employment and business laws with an eye towards minimizing legal risks in order for clients to maximize revenue. Declan attained a Senior Professional in Human Resource (SPHR) certification, the highest certification in the field of human resources. He is one of the few practicing employment lawyers in the D.C. region to have received this certification.
