Two major business groups are urging a United States court to overturn an administrative board’s decision that they assert could jeopardise defence contractors’ proprietary information.
The US Professional Services Council (PSC), which represents more than 400 companies that provide services to the federal government, and the US Chamber of Commerce have filed a “friend of the court” brief asking the US Court of Appeals for the Federal Circuit in Washington, DC, to reverse a ruling by the Armed Forces Board of Contract Appeals (ASBCA), which reviews disputes between the US Department of Defense (DoD) and contractors.
The ASBCA ruled that technical data that Boeing submitted to the government could not include markings notifying non-government entities that the information was proprietary.
