MEETING DESCRIPTION

This update will focus on Executive Order 14402, "Promoting Efficiency, Accountability, and Performance in Federal Contracting" (signed April 30, 2026) and its implications for the government contracting community. This EO:

• Directs departments and agencies to use fixed-price (FP) contracts, defined in Part 16 of the Federal Acquisition Regulation (FAR), as the default;
• Requires agency heads to provide semi-annual reports to OMB on the use of non-fixed price contracts, reflecting other actions required by this EO (e.g., written justification by (1) the contractor officer for use of any non-FP contracts and/or (2) the agency head or designee for non-FP contracts that exceed certain thresholds);
• Requires agency heads to review the 10 largest non-fixed-price contracts by dollar value and make modifications, as necessary;
• Directs OMB officials to promulgate guidance, recommend FAR changes, and develop training in support of this initiative.
